Naming the product, the job site and the year is what turns a diagnosis into a claim. That identification work is the centre of our practice.
Asbestos is only dangerous once it is disturbed. Intact asbestos-cement pipe in the ground harms nobody. Cutting that pipe with a power saw releases millions of respirable fibres — and the person holding the saw is not the only one who breathes them.
Fibres released into the air stay suspended for hours and travel well beyond the work being done. Once inhaled, the body cannot clear the durable amphibole fibres at all. They remain in the pleura for the rest of a person's life, which is why exposure that lasted a single summer in 1971 can produce a diagnosis in 2026.
Three features of these cases follow. Exposure is usually diffuse rather than from a single product. It is usually undocumented, because nobody kept records of who was in the room. And it is frequently second-hand, affecting people who never worked with asbestos in their lives.

Cracking units, heaters, exchangers and turnaround work where insulation was stripped and replaced on a large scale.
Turbine lagging, boiler insulation, cable trays and asbestos-cement board throughout the plant.
Sprayed fireproofing, joint compound, floor tile, roofing felt, cement sheet and pipe. Demolition released all of it at once.
Sanding asbestos-bearing joint compound generated some of the highest measured fibre concentrations recorded in any trade.
Locomotive boiler lagging, brake shoes, steam pipe covering and roundhouse repair.

Asbestos went home on work clothes every night for decades. The person who shook out those coveralls before putting them in the machine, and the children who hugged a father still in his work clothes, received real and measurable exposure. Courts across the country now recognise these claims.
Secondary exposure cases carry an additional evidentiary burden, because you are proving what happened in a laundry room forty years ago rather than at a documented job site. What tends to make them is specific detail: which employer, what the clothes looked like, who washed them and how, whether there was a company laundry service, and whether other family members later developed disease.
Take-home exposure is why a substantial share of our clients are women who never set foot in an industrial plant. If a mesothelioma diagnosis has no obvious occupational explanation, look at the household before concluding there is no case.
Malignant cancer of the pleura, peritoneum or pericardium. Asbestos is the only established cause, which is why these claims are the strongest in the field.
Asbestos independently causes lung cancer, and the risk multiplies sharply in smokers rather than simply adding to it. A smoking history does not defeat a claim.
Progressive scarring of the lung tissue. Not cancer, but disabling and irreversible, and it requires heavier cumulative exposure than mesothelioma does.
Scarring of the lung lining. Often symptomless, sometimes disabling, and compensable in some jurisdictions but not all.
Both are now recognised by major reviewing bodies as causally linked to asbestos exposure, including exposure through contaminated talc.
The dates matter, because liability turns on them. British factory inspectors recorded the health effects of asbestos dust in 1898. The first diagnosis of asbestosis was made in 1924, and a 1930 report to Parliament found that two thirds of workers exposed for twenty years or more had the disease. The word mesothelioma entered the medical literature in 1931.
American regulation lagged by decades. Internal industry documents produced in litigation from the late 1970s onward established that manufacturers understood the hazard from the 1930s and did not tell the workers who handled their products. That gap between knowledge and warning is the heart of a failure-to-warn case, and it is why these claims succeed against companies whose products were legal at the time.
Consumption in the United States peaked at roughly 800,000 tons in 1973. An attempted federal ban in 1989 was largely overturned in 1991, and it was not until 2024 that the EPA finalised a rule banning the remaining chrysotile uses. Millions of American buildings still contain material installed before any of that happened.
